Your duties and rights about the personal information we have about you.

You have the right to request access to the personal information we have about you by contacting us. This includes requesting:
• confirmation that we hold your personal information.
• a copy or description of the record containing your personal information; and
• the identity or categories of third parties who have had access to your personal information.

We will attend to requests for access to personal information within a reasonable time. You may be required to pay a reasonable fee to receive copies or descriptions of records, or information about third parties. We will inform you of the fee before attending to your request.

Please note that the law may limit your right to access information.

You have the right to request us to correct or delete the personal information we have about you if it is inaccurate, irrelevant, excessive, out of date, incomplete, misleading, obtained unlawfully or we are no longer authorised to keep it. A specific agreement that you have entered into with us may determine how you must change your personal information provided at the time when you entered into the specific agreement. Please adhere to these requirements. If the law requires us to keep the personal information, it will not be deleted upon your request. The deletion of certain personal information may lead to the termination of your business relationship with us.

You may object on reasonable grounds to the processing of your personal information.

We will not be able to give effect to your objection if the processing of your personal information was and is permitted by law; you have provided consent to the processing and our processing done according to your consent or the processing is necessary to conclude or perform under a contract with you.

Where you have provided your consent for the processing of your personal information, you may withdraw your consent. If you withdraw your consent, we will explain the consequences to you. We may proceed to process your personal information even if you have withdrawn your consent if the law permits or requires it. It may take up to 15 business days for the change to reflect on our systems, during this time we may still process your personal information. You must inform us of any objection in writing. You have a right to file a complaint with us or any Regulator with jurisdiction about an alleged contravention of the protection of your personal information by us. We will address your complaint as far as possible.

How we secure your personal information
• We will take appropriate and reasonable technical and organisational steps to protect your personal information according to industry best practices. Our security measures (including physical, technological, and procedural safeguards) will be appropriate and reasonable. This includes the following:

• storing our records securely.

In this document, and in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation) and other applicable regulations, “Laboratorio pHformula Internacional, S.L.” (hereinafter “pHformula”) shall provide information on its personal data protection policy so that users of the www.phformula.com website may decide expressly, freely and voluntarily to give “pHformula” the personal data that is required when they request information or purchase the various products and services offered, those of which are related to the marketing and distribution of a wide range of dermo-pharmaceutical, cosmetic and personal hygiene products.

Unless specifically stated otherwise, users must provide all the information required on the form (or its counterpart) with true, accurate, complete and current details. If not, “pHformula” may, depending on the case, either decline the user's registration or deny the particular service that has been requested. All data provided by the user/data subject will be processed according to the following specifications.

Information on personal data processing

Purpose of data processing:

All data provided will be processed for the following purposes:

- To respond to requests made by the data subject.
- To provide services related to the marketing of cosmetics.
- To maintain the relationship that may be established.
- To manage, administer, inform, provide and improve the services that are purchased.
- To send commercial communications related to our products and services.

The personal data provided will be stored until the business relationship ends, until the data subject requests their erasure, or as long as they are necessary for processing purposes. Data shall not be destroyed when there is a legal provision that requires their preservation, in which case the data shall be blocked and stored only for use by government agencies, judges and courts to address possible liabilities arising from their processing, and only for the legally prescribed time period.

Currently, no automated decisions are made (which includes profiling) based on your personal data. If such automated decisions will be made in the future, prior consent will be requested.

Legal grounds for processing:

You have given your explicit prior consent for any processing of your personal data. You are previously informed of any and all legal aspects necessary for you to give informed consent.

You may revoke this consent at any time, as explained later in this document.

Recipients, disclosure and transfer of data:

Your data will not be disclosed unless it is strictly necessary to fulfil the aforementioned purposes or to comply with a legal obligation.

Likewise, your data will not be transferred to countries outside the European Union unless it is imperative to satisfy these purposes and you give us prior and explicit authorisation to do so.

Rights of the data subject:

This request must contain the name, surname and documents that accredit the identity of the data subject or of his/her legal representative (as well as a document certifying this representation), the petition that summarises the request, an address for notification purposes, the date and signature of the applicant, and documents accrediting the petition that he/she is making. If the request does not meet the specified requirements, it will need to be corrected.

The data subject’s rights include: access, rectification, limitation, portability, opposition and erasure, which are defined as follows:

Right of access:

The data subject shall have the right to receive confirmation from the controller as to whether personal data concerning him/her are being processed and, where that is the case, the right to access that data and the following information:
a) the purposes of the processing;
b) the categories of the personal data concerned;
c) the recipients or categories of recipient to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations;
d) where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;
e) the existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing;
f) the right to lodge a complaint with a supervisory authority;
g) where the personal data are not collected from the data subject, any available information as to their source;
h) the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.

Where personal data are transferred to a third country or to an international organisation, the data subject shall have the right to be informed of the appropriate safeguards pursuant to Article 46 relating to the transfer. The data controller shall provide a copy of the personal data undergoing processing. For any further copies requested by the data subject, the controller may charge a reasonable fee based on administrative costs. Where the data subject makes the request by electronic means, and unless otherwise requested by the data subject, the information shall be provided in a commonly used electronic form.

Right to rectification:

The data subject shall have the right to obtain from the controller without undue delay the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by means of a supplementary statement.

Right to erasure:

The data subject shall have the right to obtain from the controller the erasure of personal data concerning him or her without undue delay and the controller shall have the obligation to erase personal data without undue delay where one of the following grounds applies:
a) the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;
b) the data subject withdraws consent on which the processing is based according to point (a) of Article 6(1), or point (a) of Article 9(2), and where there is no other legal ground for the processing;
c) the data subject objects to the processing pursuant to Article 21(1) and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2);
d) the personal data have been unlawfully processed;
e) the personal data have to be erased for compliance with a legal obligation set out in the Union or Member State law to which the controller is subject;
f) the personal data have been collected in relation to the offer of information society services referred to in Article 8(1).

Where the controller has made the personal data public, those of which the data subject has exercised his or her right to erasure, the controller, taking account of available technology and the cost of implementation, shall take reasonable steps to inform controllers that are processing the personal data that the data subject has requested erasure of the information, as well as any link to, or copy or replication of, them.

This right shall be limited by other rights, such as the right to freedom of expression and information, or for compliance with a legal obligation, or for reasons of public interest.

Right to restriction of processing:

The data subject shall have the right to obtain from the controller restriction of processing where one of the following applies:

a) the accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data;
b) the processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead;
c) the controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims;
d) the data subject has objected to processing pursuant to Article 21(1) pending the verification whether the legitimate grounds of the controller override those of the data subject.

Where processing has been restricted under paragraph 1, such personal data shall, with the exception of storage, only be processed with the data subject's consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.

A data subject who has obtained restriction of processing pursuant to paragraph 1 shall be informed by the controller before the restriction of processing is lifted.

Right to object:

The data subject shall have the right to object at any time, on grounds relating to his or her particular situation, to processing of personal data concerning him or her which is based on point (e) or (f) of Article 6(1), including profiling based on those provisions.

The controller shall no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims.

Where personal data are processed for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing, which includes profiling to the extent that it is related to such direct marketing.

Where the data subject objects to processing for direct marketing purposes, the personal data shall no longer be processed for such purposes.

Where personal data are processed for scientific or historical research purposes or statistical purposes pursuant to Article 89(1), the data subject, on grounds relating to his or her particular situation, shall have the right to object to processing of personal data concerning him or her, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

Right to data portability:

The data subject shall have the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, where:
a) the processing is based on consent pursuant to point (a) of Article 6(1) or point (a) of Article 9(2) or on a contract pursuant to point (b) of Article 6(1); and
b) the processing is carried out by automated means.

2. In exercising his or her right to data portability pursuant to paragraph 1, the data subject shall have the right to have the personal data transmitted directly from one controller to another, where technically feasible.

The exercise of the right referred to in paragraph 1 of this Article shall be without prejudice to Article 17. That right shall not apply to processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

The controller shall communicate any rectification or erasure of personal data or restriction of processing carried out in accordance with Article 16, Article 17(1) and Article 18 to each recipient to whom the personal data have been disclosed, unless this proves impossible or involves disproportionate effort. The controller shall inform the data subject about those recipients if the data subject requests it.


Withdrawal of consent: Any data subject who has given prior consent to processing of his or her personal data may just as easily withdraw it at any time. The withdrawal of consent shall not affect the lawfulness of processing before its withdrawal.

The data subject shall have the right to lodge a complaint with a competent supervisory authority.

Where personal data are to be further processed for different purposes, the controller shall inform the data subject accordingly.

Security measures: The data controller declares that it has adopted the necessary technical and organisational measures to ensure appropriate security of the data and to avoid its alteration, loss, unauthorised processing or access, while taking into account the state of technology, the nature of the stored data and the risks to which it is exposed, either from human activity or from the physical or natural environment.

A través del presente aviso, “Laboratorio pHformula Internacional, S.L.” (en adelante “pHformula”), informa a los usuarios de la Web www.phformula.com, en cumplimiento del Reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo, de 27 de abril de 2016 (Reglamento General de Protección de Datos) y demás normativa de aplicación, de su política de protección de datos personales con la finalidad que éstos decidan de forma expresa, libre y voluntaria, facilitar a “pHformula” los datos personales que les son solicitados motivado por la solicitud de información o para la contratación de los diversos productos y servicios que se ofrecen relacionados con la comercialización y distribución de toda clase de productos dermofarmacéuticos, cosméticos y de higiene personal.

Excepto que específicamente se establezca lo contrario, se considera necesario completar todos los datos requeridos en el formulario o impreso análogo de forma verdadera, exacta, completa y actualizada. En caso contrario, “pHformula” podrá, dependiendo del caso, no proceder al registro del usuario, o bien denegar el servicio concreto solicitado. Todos los datos facilitados por el usuario/interesado serán tratados atendiendo a las características pormenorizadas a continuación.


Información relativa al tratamiento de los datos personales

Finalidad del tratamiento:

Todos los datos facilitados serán tratados con las siguientes finalidades:

- Dar respuesta a las peticiones realizadas por el interesado.
- Prestar los servicios relacionados con la comercialización de cosméticos.
- Mantenimiento de la relación que en su caso se establezca.
- Gestión, administración, información, prestación y mejora de los servicios que se decida contratar.
- Comunicaciones comerciales relacionadas con nuestros productos y servicios.

Los datos personales proporcionados se conservarán mientras se mantenga la relación mercantil, el interesado no solicite su supresión o sean necesarios para los fines del tratamiento. No procederá la destrucción de los datos cuando exista una previsión legal que exija su conservación, en cuyo caso se procederá al bloqueo de los datos, conservándose únicamente a disposición de las Administraciones públicas, Jueces y Tribunales, para la atención de las posibles responsabilidades nacidas del tratamiento, durante el plazo de prescripción de éstas.

En la actualidad no se procede a realizar ningún tipo de decisiones automatizadas, incluida la elaboración de perfiles, en base a sus datos personales. En el caso en que en un futuro se fueran a realizar dichas decisiones automatizadas, se recabará el consentimiento previo.

Legitimación del tratamiento:

Todo tratamiento realizado sobre sus datos personales ha sido consentido por Ud. de forma previa y expresa. Con carácter previo se le informa de todos aquellos extremos exigidos por la Ley para que pueda prestar un consentimiento informado.

Podrá revocar este consentimiento en cualquier momento tal y como se detalla más adelante en el presente documento.

Destinatarios, cesiones y transferencias de datos:

Sus datos no serán cedidos salvo que sean estrictamente indispensable para el cumplimiento de las finalidades anteriormente dichas u obligación legal.

Igualmente, sus datos tampoco serán transferidos a países fuera de la Unión Europea salvo que fuera indispensable para el cumplimiento de las finalidades y Ud. nos autorice de forma previa y expresa.

Derechos de los interesados:

Podrá ejercitar en cualquier momento los derechos que se detallan a continuación, mediante correo postal a “pHformula”, Pont Reixat, 3, 1º, 08960 de Sant Just Desvern (Barcelona); o mediante correo electrónico a info@phformula.com. La solicitud deberá contener nombre, apellidos y la documentación que acredite la identidad del interesado o de su representante legal, así como documento acreditativo de la representación, petición en la que se concrete la solicitud, domicilio a efectos de notificaciones, fecha y firma del solicitante y documentos acreditativos de la petición que formula. Si la solicitud no reúne los requisitos especificados se requerirá su subsanación.

Los derechos de los interesados son: de acceso, rectificación, limitación, portabilidad, oposición y supresión; y su definición es:

Derecho de acceso:

El interesado tendrá derecho a obtener del responsable del tratamiento confirmación de si se están tratando o no datos personales que le conciernen y, en tal caso, derecho de acceso a los datos personales y a la siguiente información:
a) los fines del tratamiento
b) las categorías de datos personales de que se traten
c) los destinatarios o las categorías de destinatarios a los que se comunicaron o serán comunicados los datos personales, en particular destinatarios en terceros u organizaciones internacionales
d) de ser posible, el plazo previsto de conservación de los datos personales o, de no ser posible, los criterios utilizados para determinar este plazo
e) la existencia del derecho a solicitar del responsable la rectificación o supresión de datos personales o la limitación del tratamiento de datos personales relativos al interesado, o a oponerse a dicho tratamiento
f) el derecho a presentar una reclamación ante una autoridad de control
g) cuando los datos personales no se hayan obtenido del interesado, cualquier información disponible sobre su origen
h) la existencia de decisiones automatizadas, incluida la elaboración de perfiles, a que se refiere el artículo 22, apartados 1 y 4, y, al menos en tales casos, información significativa sobre la lógica aplicada, así como la importancia y las consecuencias previstas de dicho tratamiento para el interesado.

Cuando se transfieran datos personales a un tercer país o a una organización internacional, el interesado tendrá derecho a ser informado de las garantías adecuadas en virtud del artículo 46 relativas a la transferencia. El responsable del tratamiento facilitará una copia de los datos personales objeto de tratamiento. El responsable podrá percibir por cualquier otra copia solicitada por el interesado un canon razonable basado en los costes administrativos. Cuando el interesado presente la solicitud por medios electrónicos, y a menos que este solicite que se facilite de otro modo, la información se facilitará en un formato electrónico de uso común.

Derecho de rectificación:

El interesado tendrá derecho a obtener sin dilación indebida del responsable del tratamiento la rectificación de los datos personales inexactos que le conciernan. Teniendo en cuenta los fines del tratamiento, el interesado tendrá derecho a que se completen los datos personales que sean incompletos, inclusive mediante una declaración adicional.

Derecho de supresión:

El interesado tendrá derecho a obtener sin dilación indebida del responsable del tratamiento la supresión de los datos personales que le conciernan, el cual estará obligado a suprimir sin dilación indebida los datos personales cuando concurra alguna de las circunstancias siguientes:
a) los datos personales ya no sean necesarios en relación con los fines para los que fueron recogidos o tratados de otro modo
b) el interesado retire el consentimiento en que se basa el tratamiento de conformidad con el artículo 6, apartado 1, letra a), o el artículo 9, apartado 2, letra a), y este no se base en otro fundamento jurídico
c) el interesado se oponga al tratamiento con arreglo al artículo 21, apartado 1, y no prevalezcan otros motivos legítimos para el tratamiento, o el interesado se oponga al tratamiento con arreglo al artículo 21, apartado 2
d) los datos personales hayan sido tratados ilícitamente
e) los datos personales deban suprimirse para el cumplimiento de una obligación legal establecida en el Derecho de la Unión o de los Estados miembros que se aplique al responsable del tratamiento
f) los datos personales se hayan obtenido en relación con la oferta de servicios de la sociedad de la información mencionados en el artículo 8, apartado 1

Cuando el responsable haya hecho público los datos personales de los cuales el interesado ha ejercido su derecho de supresión, el responsable deberá adoptar, atendiendo la tecnología disponible y el coste de su aplicación, las medidas razonables para comunicar a los terceros que estén tratando esa información de la solicitud de supresión de los datos, así como de cualquier enlace a esos datos o a cualquier copia o replica de los mismos.

Este derecho se verá limitado por otros derechos tales como el derecho a la libertad de expresión e información, por el cumplimiento de alguna obligación legal, o cuando existan razones de interés público.

Derecho a la limitación del tratamiento:

El interesado tendrá derecho a obtener del responsable del tratamiento la limitación del tratamiento de los datos cuando se cumpla alguna de las condiciones siguientes:

a) el interesado impugne la exactitud de los datos personales, durante un plazo que permita al responsable verificar la exactitud de los mismos
b) el tratamiento sea ilícito y el interesado se oponga a la supresión de los datos personales y solicite en su lugar la limitación de su uso
c) el responsable ya no necesite los datos personales para los fines del tratamiento, pero el interesado los necesite para la formulación, el ejercicio o la defensa de reclamaciones
d) el interesado se haya opuesto al tratamiento en virtud del artículo 21, apartado 1, mientras se verifica si los motivos legítimos del responsable prevalecen sobre los del interesado

Cuando el tratamiento de datos personales se haya limitado en virtud del apartado 1, dichos datos solo podrán ser objeto de tratamiento, con excepción de su conservación, con el consentimiento del interesado o para la formulación, el ejercicio o la defensa de reclamaciones, o con miras a la protección de los derechos de otra persona física o jurídica o por razones de interés público importante de la Unión o de un determinado Estado miembro.

Todo interesado que haya obtenido la limitación del tratamiento con arreglo al apartado 1 será informado por el responsable antes del levantamiento de dicha limitación.

Derecho de oposición:

El interesado tendrá derecho a oponerse en cualquier momento, por motivos relacionados con su situación particular, a que datos personales que le conciernan sean objeto de un tratamiento basado en lo dispuesto en el artículo 6, apartado 1, letras e) o f), incluida la elaboración de perfiles sobre la base de dichas disposiciones.

El responsable del tratamiento dejará de tratar los datos personales, salvo que acredite motivos legítimos imperiosos para el tratamiento que prevalezcan sobre los intereses, los derechos y las libertades del interesado, o para la formulación, el ejercicio o la defensa de reclamaciones.

Cuando el tratamiento de datos personales tenga por objeto la mercadotecnia directa, el interesado tendrá derecho a oponerse en todo momento al tratamiento de los datos personales que le conciernan, incluida la elaboración de perfiles en la medida en que esté relacionada con la citada mercadotecnia.

Cuando el interesado se oponga al tratamiento con fines de mercadotecnia directa, los datos personales dejarán de ser tratados para dichos fines.

Cuando los datos personales se traten con fines de investigación científica o histórica o fines estadísticos de conformidad con el artículo 89, apartado 1, el interesado tendrá derecho, por motivos relacionados con su situación particular, a oponerse al tratamiento de datos personales que le conciernan, salvo que sea necesario para el cumplimiento de una misión realizada por razones de interés público.

Derecho de portabilidad de datos:

El interesado tendrá derecho a recibir los datos personales que le incumban, que haya facilitado a un responsable del tratamiento, en un formato estructurado, de uso común y lectura mecánica, y a transmitirlos a otro responsable del tratamiento sin que lo impida el responsable al que se los hubiera facilitado, cuando:
a) el tratamiento esté basado en el consentimiento con arreglo al artículo 6, apartado 1, letra a), o el artículo 9, apartado 2, letra a), o en un contrato con arreglo al artículo 6, apartado 1, letra b), y
b) el tratamiento se efectúe por medios automatizados.

2.Al ejercer su derecho a la portabilidad de los datos de acuerdo con el apartado 1, el interesado tendrá derecho a que los datos personales se transmitan directamente de responsable a responsable cuando sea técnicamente posible.

El ejercicio del derecho mencionado en el apartado 1 del presente artículo se entenderá sin perjuicio del artículo 17. Tal derecho no se aplicará al tratamiento que sea necesario para el cumplimiento de una misión realizada en interés público o en el ejercicio de poderes públicos conferidos al responsable del tratamiento.

El responsable del tratamiento comunicará cualquier rectificación o supresión de datos personales o limitación del tratamiento efectuada con arreglo al artículo 16, al artículo 17, apartado 1, y al artículo 18 a cada uno de los destinatarios a los que se hayan comunicado los datos personales, salvo que sea imposible o exija un esfuerzo desproporcionado. El responsable informará al interesado acerca de dichos destinatarios, si este así lo solicita.


Revocación del consentimiento: El interesado, que en su momento hubiera otorgado el consentimiento para tratar sus datos personales, podrá igualmente retirarlo con igual facilidad. La retirada del consentimiento no comportará la ilicitud del tratamiento efectuado con anterioridad.

El interesado tendrá derecho a presentar una reclamación ante la Autoridad de Control competente.

Cuando los datos personales vayan a ser tratados de forma posterior para finalidades distintas, el responsable informará al interesado de tal extremo.

Medidas de seguridad: El Responsable del Tratamiento manifiesta que ha adoptado las medidas de índole técnica y organizativa necesarias para garantizar la seguridad de los datos y evitar su alteración, pérdida, tratamiento o acceso no autorizado, teniendo en cuenta el estado de la tecnología, la naturaleza de los datos almacenados y los riesgos a que se encuentran expuestos, ya provengan de la acción humana o del medio físico o natural.
